Terms of service

These terms are an agreement between you and JurikTech s.r.o, Company ID (IČO) 56723326, Slovakia ("we", "us"), who runs Pulz8. They cover the web app at app.pulz8.com, the Pulz8 API and the website at pulz8.com (together, "Pulz8"). By creating an account or using Pulz8 you accept these terms. If you accept them for a gym, studio or team, you confirm you are allowed to bind it. Pulz8 was previously called Heartstream.

Our Privacy policy explains how we handle personal data.

What Pulz8 does

Pulz8 shows live heart-rate zones from Bluetooth heart-rate sensors in the browser, on a laptop, phone or TV. You can save training sessions and review them afterwards: duration, average and peak heart rate, time in zone and heart rate over time.

Pulz8 needs Chrome or Edge with Web Bluetooth on Windows, macOS, ChromeOS or Android, and sensors that broadcast standard Bluetooth heart rate. How many sensors connect at once depends on your Bluetooth adapter. Safari, Firefox and browsers on iPhone and iPad are not supported.

Your account

  • You must be at least 16 to create an account.
  • Give a correct email address and keep it up to date; we use it to sign you in and to contact you about the service.
  • Keep your password safe and do not share your account. You are responsible for what happens under it. Tell us at once if you think someone else has used it.
  • You can sign in with email and password or with Google. If you use Google, Google's terms also apply to that sign-in.

Plans and pricing

  • Personal accounts ("Just me") are free, for one athlete training on their own.
  • Team accounts for gyms and teams cost €49 per month, or €490 per year, for the whole gym, however many athletes train with it. A new team gets a 7-day free trial with no card. After it, the team owner subscribes in the app; we charge through Stripe at the start of each month or year, in advance, and any taxes that apply are shown on the invoice. If we set up a team by hand, we agree the start date and how you pay instead.
  • You can cancel a team plan at any time in the app's billing settings; it ends at the close of the month or year already paid for. We do not refund part periods, except where the law requires it.
  • We may change prices. We tell team owners at least 30 days before a new price applies, and you can cancel before then.
  • We may add or remove features of the free plan. If we stop offering the free plan, we will tell personal account owners at least 30 days ahead, so they can ask for a copy of their data.

Gyms, teams and their athletes

If you run a team account, you are responsible for the athletes you add and for the data you enter about them. In particular, you must:

  • tell your athletes that you use Pulz8, what data you record about them and why, and point them to our Privacy policy;
  • have a legal basis for processing their data. Heart rate is health data, so this is normally the athlete's explicit consent, and for athletes under 16 the consent of a parent or guardian;
  • only pair and record athletes who have agreed to it, and stop recording an athlete who asks you to;
  • deal with your athletes' requests to see, correct or delete their data. We will help you with this.

Data processing for teams

For the athlete data a team enters, the team is the controller and we are its processor. These terms are our data processing agreement under Article 28 of the GDPR:

  • Subject and duration: hosting and processing athlete data to provide Pulz8, for as long as the team account exists.
  • Data: athlete name, email, date of birth, gender, weight, heart-rate settings, sensor assignments and recorded sessions, including heart rate, which is health data. The data subjects are the team's athletes and staff.
  • Instructions: we process the data only to provide Pulz8 as the team uses it, or as the law requires. If we believe an instruction breaks data protection law, we tell you.
  • Confidentiality and security: anyone who processes the data for us is bound to confidentiality. We apply the security measures described in our Privacy policy.
  • Sub-processors: you authorise the service providers listed in our Privacy policy. We tell team owners at least 30 days before adding or replacing one, and you may object; if we cannot address the objection you can end the plan.
  • Assistance: we help you answer data subject requests, handle breaches, and carry out impact assessments where needed, as far as Pulz8's role allows.
  • Breaches: we tell you without undue delay after we become aware of a personal data breach affecting your athletes.
  • End of the service: when the team account is closed, we return the data on request and then delete it as described in our Privacy policy, unless the law requires us to keep it.
  • Audits: we give you the information you need to show compliance with Article 28 and answer reasonable written questions about our processing.

Health and safety

Pulz8 is a training tool, not a medical device. It does not diagnose, treat, prevent or monitor any medical condition, and it is not an emergency or safety system.

  • Zones are based on a maximum heart rate that is either entered or estimated from age, so they are approximations. Sensors can drop out, lag or report wrong values.
  • Do not rely on Pulz8 to decide whether exercise is safe for you. Talk to a doctor before starting a training programme, especially if you have a heart condition, high blood pressure or another health concern, or if you are pregnant.
  • Stop exercising and get help if you feel chest pain, dizziness, faintness or unusual shortness of breath, whatever the screen shows.
  • Coaches and gyms remain responsible for supervising their sessions and their athletes' safety.

Acceptable use

Do not:

  • use Pulz8 against the law, or to record someone's heart rate without their agreement;
  • try to access other accounts or data, probe or break our security, or get around usage limits;
  • overload, disrupt or reverse-engineer the service or the API, except as the law allows or an open-source licence permits;
  • use automated means to create accounts or scrape the service;
  • resell or rent access to Pulz8 without our written agreement.

We may suspend or close accounts that break these rules.

Your data and our service

You keep all rights in the data you put into Pulz8. You give us permission to store, process and display it only as needed to provide Pulz8 to you, and as described in our Privacy policy. You can ask for a copy of it at any time.

Pulz8, its name, logo and design belong to us. Where we publish source code under an open-source licence, that licence governs the code. If you send us feedback or ideas, we may use them without owing you anything.

Availability and changes

We work to keep Pulz8 running and your data safe, but we do not promise it will always be available, error-free or compatible with every browser, device or sensor. We may need to take it offline for maintenance. Browser makers can change how Web Bluetooth works, which can affect Pulz8.

We may change, add or remove features. If a change removes something a paying team relies on, we tell the team owner in advance and it can cancel.

Ending your account

You can stop using Pulz8 at any time. To delete your account and its data, email [email protected] from the address on the account.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or, for free accounts unused for more than 2 years, after warning you by email at least 30 days ahead. Where we can, we tell you first and let you export your data.

Liability

Nothing in these terms limits liability that cannot be limited by law, including for intent, gross negligence, or death or personal injury caused by our negligence.

Otherwise:

  • the free plan is provided as it is, without warranties beyond those the law requires;
  • we are not liable for indirect or consequential losses, or for lost profits, revenue or data you could have kept by exporting it;
  • our total liability to you for all claims in any 12 months is limited to what you paid us in that period, or €50 if you paid nothing.

Consumers

If you use Pulz8 as a consumer, you keep all the rights that the consumer protection law of the country where you live gives you, and nothing in these terms takes them away.

Changes to these terms

We may update these terms. We change the date at the top, and for changes that affect you materially we tell you by email or in the app at least 30 days before they apply. If you do not agree, you can stop using Pulz8 and close your account before then.

Law and disputes

These terms are governed by the laws of Slovakia. Disputes go to the courts of Slovakia. If you are a consumer in the EU, you can also bring a claim in the courts of the country where you live, and its mandatory consumer rules still apply.

We publish these terms in English, Slovak and Czech. If the versions differ, the English version applies, unless the law where you live says otherwise.
